Casey Roy has practiced as a commercial bankruptcy attorney for 30 years and has a breadth of experience that is truly unique. During his career, Mr. Roy has developed expertise in the intersection of state regulatory and federal bankruptcy law, particularly in the health care space. He began his practice upon law school graduation as an associate at Sheinfeld, Maley & Kay, P.C., a Texas-based Chapter 11 bankruptcy firm that represented debtors in some of the largest cases in the United States. He continued to hone his practice in Houston at McClain Patchin, P.C., where he represented both debtors and official committees in cases in a variety of industries, as well as liability insurers of Chapter 11 debtors in asbestos-related bankruptcies involving billions of dollars in claims.

Mr. Roy subsequently answered a call to public service in Austin, serving for 12 years as an Assistant Attorney General with the Texas Attorney General’s Office. He was regulatory counsel to Texas state agencies in complex bankruptcy matters, with an emphasis on cases in the health care market involving senior living and skilled nursing operators, acute care hospitals, surgical centers, home health agencies, hospice, and behavioral providers. Mr. Roy also gained expertise on environmental, energy and consumer protection-focused bankruptcy cases. While at the Texas Attorney General’s Office, Mr. Roy represented a host of client agencies on regulatory issues in bankruptcy, including the Texas Health and Human Services Commission, the Texas Board of Medical Examiners, the Railroad Commission of Texas, the Texas General Land Office, the Texas Department of Aging and Disability Services, the Texas Department of Insurance, the Texas Department of Motor Vehicles, the Texas Racing Commission, the Texas Lottery Commission, the Texas Department of Information Resources, the Texas A&M and Texas Tech University Systems, and the Consumer Protection and Charitable Trusts Divisions of the Texas Attorney General’s Office.

Immediately prior to joining Ross, Smith & Binford, Mr. Roy served for approximately three years as a Trial Attorney with the United States Department of Justice’s United States Trustee program. While with the Department of Justice, he was responsible for oversight of Chapter 11 and Chapter 7 bankruptcy proceedings filed in the Western District of Texas on behalf of the United States Trustee for Region 7. Mr. Roy represented the United States Trustee on all matters in Chapter 11 cases, including “first-day” motions, employment of estate professionals, coordination with and appointment of official statutory committees and Chapter 11 trustees, litigation of enforcement actions in Chapter 7 cases including discharge objections, and trial of dismissal actions for abuse of the bankruptcy system. His oversight included the selection and appointment of statutory patient care ombudsmen in health care cases, working with those persons on communication between providers and courts to ensure adequate representation of patient interests. In addition, during his tenure with the Department of Justice, Mr. Roy served a dual role as counsel to the United States Trustee in complex Chapter 11 healthcare cases filed in the Southern District of Texas.
